These Terms of Service ("Terms") govern your use of DMG Press services, including our website at dmgpress.app, our artist dashboard at dashboard.dmgpress.app, and the production and fulfillment of NFC music cards ("Services"). By placing an order or creating an account, you agree to these Terms. If you do not agree, do not use our Services.
DMG Press is operated by Digital Music Group, Atlanta, GA.
You must be at least 18 years old to place an order or create an artist account. By using our Services, you represent that you meet this requirement. If you are under 18, you may not use our Services.
When you create an account, you are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at [email protected].
You may not create accounts for others without their consent or create multiple accounts for the same artist without prior written approval.
You retain full ownership of all content you upload to your artist page — music, photos, videos, and other materials. By uploading content, you grant DMG Press a limited, non-exclusive license to host, display, and deliver that content to fans who tap your NFC cards. This license exists solely to provide the Services and does not transfer any ownership rights.
You are solely responsible for ensuring you have the right to use all content you upload. This includes music samples, photographs, and any third-party materials. DMG Press is not responsible for copyright infringement claims arising from content you upload.
You may not upload or use our Services to distribute content that:
DMG Press reserves the right to remove any content and terminate any account that violates these restrictions without refund.
All orders are subject to acceptance and availability. We reserve the right to refuse any order. Prices are listed in USD and subject to change without notice. Prices in effect at the time of your order apply to that order.
Payment is processed by Stripe. By placing an order, you authorize us to charge the payment method on file. All sales are final once production has begun — see our Refund Policy in Section 7.
Due to the custom nature of our products, all sales are final once your order enters production (typically within 48 hours of order confirmation). Before production begins, you may cancel your order for a full refund by contacting [email protected].
If your cards arrive damaged or defective, we will replace them or issue a refund at our discretion. Contact us with photos of the issue within 14 days of delivery.
We aim to fulfill orders within the timeframes stated on our website (typically 2–3 weeks). These are estimates, not guarantees. Delays caused by shipping carriers, supply chain issues, or circumstances outside our control are not grounds for cancellation or refund once production has begun.
Risk of loss passes to you upon delivery to the shipping carrier.
The artist dashboard and analytics are provided as-is. We do not guarantee uptime, data accuracy, or uninterrupted access. We reserve the right to modify or discontinue features with or without notice, though we will make reasonable efforts to provide advance notice of material changes.
All DMG Press branding, platform code, design, and original content are the property of Digital Music Group. You may not copy, reproduce, or create derivative works without written permission.
To the fullest extent permitted by law, DMG Press is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to lost profits, lost revenue, or data loss. Our total liability for any claim arising from your use of our Services shall not exceed the amount you paid for the specific order giving rise to the claim.
You agree to indemnify and hold DMG Press, Digital Music Group, and its officers, employees, and partners harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of our Services, your content, or your violation of these Terms.
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Atlanta, Georgia.
We may update these Terms at any time. Material changes will be communicated to active artists via email. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
